These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Doctor", "Practice", or "Consumer") and Mad Dogs Daughter, a California S-Corporation (EIN: 93-2498097), doing business as Upper Cervical Connect ("Upper Cervical Connect", "Platform", "we", "us", or "our"), with corporate offices at 2108 N St #5640, Sacramento, CA 95816-5712.
By accessing our website (uppercervicalconnect.com), utilizing our practice growth software, or opting in to receive SMS text communications powered by our telecommunications infrastructure, you accept and agree to be bound by these Terms.
2. Description of Services
Upper Cervical Connect provides specialized software, website infrastructure, lead generation CRM, call-tracking routing, and automated missed-call SMS services designed exclusively for independent upper cervical chiropractic practices, including partner practices such as Hope Brain & Body Center Southlake (hopesouthlake.com).
Upper Cervical Connect is a technology provider and does not practice chiropractic or medicine. The information provided on our websites, case studies, or automated communications is for educational and administrative coordination purposes only. Submitting an inquiry or receiving an automated appointment reminder does not establish a doctor-patient relationship until a formal clinical examination is conducted by a licensed doctor of chiropractic.
4. HIPAA & Business Associate Agreements
For participating doctors and clinics, our processing of Protected Health Information (PHI) is strictly governed by the HIPAA Business Associate Agreement (BAA) executed between Mad Dogs Daughter and your practice entity. We implement physical, technical, and administrative safeguards to protect all patient data in compliance with HIPAA and HITECH standards.
By submitting a consultation request, contact inquiry, or checking an SMS consent checkbox on any website operated or powered by Upper Cervical Connect (including client practices such as Hope Brain & Body Center Southlake), you expressly agree to the following mobile messaging terms:
- • Program Name:Upper Cervical Connect Practice Alerts & Patient Care Coordination.
- • Program Description:Messages include appointment confirmations, consultation reminders, scheduling follow-ups, and clinic coordination on behalf of your designated upper cervical doctor.
- • Message Frequency:Message frequency varies depending on your consultation requests and appointment scheduling needs.
- • Rates:Message and data rates may apply depending on your cellular carrier plan.
- • Opt-Out / STOP:You can cancel the SMS service at any time. Simply text STOP, CANCEL, QUIT, or UNSUBSCRIBE to any message received. You will receive an immediate opt-out confirmation text.
- • Help & Support:For assistance, text HELP to any message or contact our support team at [email protected] or call (833) 822-2273.
- • Carrier Liability:Carriers (including AT&T, T-Mobile, Verizon, and regional carriers) are not liable for delayed or undelivered messages.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Mad Dogs Daughter, Upper Cervical Connect, and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or telecommunications services.
7. Governing Law & Jurisdiction
These Terms and any dispute arising from your use of Upper Cervical Connect shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any legal proceeding shall be filed exclusively in the state or federal courts located in Sacramento County, California.
